 No Charges Filed Against Parents In Wash U Baby Death Case

Circuit Attorney Jennifer M. Joyce announced Tuesday that she has made a decision regarding the case of baby Sophia Kuntsen. “While the parents of this baby demonstrated questionable parenting and communication skills on that day, I do not have enough evidence to prove ‘criminal negligence’ beyond a reasonable doubt, and that is the legal threshold for charging this crime,” says Joyce.

 This decision makes me sick.  If these parents get off, so should the day care worker.  If we go off the reason the parents are not charged.

This just infuriates me!! Any kind of this type of case needs to be dismissed from now on then. If they are free to forget there child, no one else should be held accountable for their children or pets any more either, right?? WRONG! You should not be able to pick and choose who you want to punish in these kind of cases! ARGHH!

I am happy to see I am not the only one on this page. They were "let go" because of their social standing. That is wrong. I say dismiss all charges against the day care worker and the poor officer who lost his dog. What is wrong with this world??? ergh!!!

I think the daycare worker should get off also.At least that child did not die.I realize they have to live the rest of their lives living with this.Hope they pay attention to their other child better now.

As a mother of 4 children ages 7months to 7 years i have very mixed feelings. nothing the prosecutors wouldve done to these parents wouldve been worse than the "if onlys" they are going to live with for the rest of their lives. None of us are perfect, not one of us.

I do not have enough evidence to
prove‘criminal negligence’ beyond a reasonable doubt??? Excuse me they left the baby in the car. How is this not criminally neglectful? I know if I were a jurist my vote would be guilty guilty guilty! Absolutely no doubt in my mind. jmo

I thank they should have been sentenced, to some jailtime or some other punishment. I have Three children of my own, and Three Grandchild. Even though there not with me at all times. I always check my car to make sure I have everything before leaving my car. If the Father would have just checked his car before leaving this would have never happened. Parents need to slow down and pay attention the the world around them. Life is to short not to.

HUGE SURPRISE! Money and prestige, high dollar jobs for the parents at a major hospital equals skip to freedom. Nurseryworker? Charged. She didnt have high friends and money. The lame excuse that the difference between the two cases was the nurseryworker 'knew' there were kids on the bus (and these two, who put their kids in the car, didnt?) and it is her job to take care of them... what is a parent, for Pete's sake?? Is it not their job to pull their heads out of their butts and remember their children are more important than where to park their car? Outrageous. Either the law is the same for all, or for none. Charges should be dismissed against the nurseryworker and everyone else. So far, I have seen charges filed on parents with middle to low income. Rich people or those well off and well known? They take a walk. Circuit Attorney Jennifer Joyce has shown gross favoritism, and should be shown the door. See how fast she will remain buddy buddy with the two doctors once she is in no position to pass out favors. DISGUSTING!

This decision is sickening. Especially giving the fact the mother is, and should be was, a pediatrician. If she can't exercise good parenting skills what will she do in practice. The attorney said they haven't had time to grieve but they certainly wasted no time retaining a high profile attorney. We haven't seen pictures but we know social class had everything to do with this. Joyce is pathetic and too deserves to be disbarred.

I agree one hundred percent. This is outrage. There is no justice in this case. They both should have been charged. They knew the baby was in the cr when they left the house. A job is not worth taking a child life.

The Mother called the father and asked him to meet her in front of the hospital so that he could park the car in a new lot.
She thought that he knew that the baby was in the car.
He assumed that she had already taken care of the baby.
What the DA is saying is that NEITHER party intentionally left the child in the car. BOTH parties thought the other was taking care of the baby.
The daycare worker's job was to take a head count--not once, but multiple times throughout the visit at the science center. If the daycare worker had, at any time, during the time that they were in the science center, done a count--she would've known she was short a child.
Since both parents thought the other had taken care of the baby, neither was liable.

I have mixed feelings about this case. Yes they were in the wrong, but like others have stated what could have the courts possibly done to punish them even more than they are going to punish themselves? They still have another child that they have to take care of.

And there is a GREAT difference between the case of the parents and the daycare worker. I worked at a daycare and there is NO WAY that that child should have been forgotten on that bus. You double, triple, quarduple check that there are no more children left on there. Those are not your kids you are putting in danger those are someone elses. Also it is your job to make sure that those children are safe and well taken care of, there is no excuse for it, none what so ever.

They are doomed for life.....Prison probably would have been better than the struggle ahead of them..... I would be ruined for life if my neglect would have killed a baby.... Co workers and friends and family will look at them and treat them different..... Im sure this is not the end of this story......

I've read a lot of the comments and I agree with some and don't understand about others. Yes the daycare worker should have rechecked and rechecked. But if it is your own children don't you think it's your job to check and recheck to make sure all your children are out of the car no matter who thought what?????.. I agree that money and sociaty played a big part in this. Yes everyone makes misstakes, but the law usually don't care and they charge you with something or whatever suits them at that time. If a person can be sent to jail on neglect of a animal or curalty or for killing an animal, why is it that a person can get away with killing sometimes and or injuring a person, it tells me this world is a little backwards. No doubt Mike Vic should get charged for dog fighting, but his punishment will be harsher than what Little got for killing a person, what is wrong with this picture???. When a person kills or hurt someone in a car accident, key word, accident, something not intentional, will get manslaughter and jail time. These parents may have done it not intentional, but they get nothing, what is wrong with that picture????. But you know there is only one real person they have to answer and that is Our Heavenly Father, our creator. God knows all and he will be our final judge.

Since someone brought up the Micheal Vick case. My thoughts are how sick this world are and how to get away with murder. HE is not responsible for the dogs killing one another. He just stood there and watched, or whatever, but he didn't personal inflict injury to those animals. What about the people who hunt for "sport" and actually get licensed to do so. What is that? St. Louis is still the most dangerous place to live when you have prosecuting attorneys like Joyce in position, while school districts are failing our children, and Micheal Devlins at least receive a bond when Alma King was denied for defending her house and family. ????

This makes me so angry, I am a mother of two and at the time I had my children, I was told I was to young to have them. I, at the time, had no education and was a single mother. Not once did my children get mistakenly left anywhere. I was always aware of where they were especially @ such a defenseless age. If this had been me with the same excuse I would be in jail.
Where is the Justice? Unbelieveable!

The Daycare Worker was made to look like the worst person in the world and the child was in the van for 7 minutes. Her picture was all over the news and I haven't seen one picture of the Wash U parents yet... hummmm. I feel sorry for her because I know what she's thinking right now. And these scum killed their child and they're getting off, nobody wants to say whats going on here... then again we never do. Instead we make up lame excuses as to why another person gets treated differently.

I think these parents should be prosecuted! If you are too pre-occupied to know you have a child in the car, then you don't need to be a parent. It is the parents job to know where your kids are. The "I didn't know" excuse is used up! If they were doctors, they would be in jail!

Alpha Dog Target is the only place to shop!!! **Remember when ever you are on a bike, motorized or not, put on a helmet. Your arm(s) & leg(s) will heal, but what about the most important part of your body...head??? Food for thought.
