I have had some friends who have called off weddings and it was never pretty.. but the ring was a pretty easy issue.
But it seems that it isn't always the case. Take a look at these court cases where there was a huge battle over the bling!
A "What happens to the
engagement ring when the wedding falls through?" court case went all the way to the state
Court of Appeals. The trial court held that the passing of the ring is a gift
and that the woman should keep it even if the marriage falls through.
But the appeals court said the ring should go back to the guy who bought
it because while it is a gift, the gift is conditional. An engagement ring is
given in contemplation of marriage, and is therefore a conditional gift. If the
marriage "for whatever reason" does not occur, the giver gets the ring back,"
the court said.
In the ruling, you will see some very
interesting cases on which the Tennessee court built its decision.
The
Tennessee court leaned in on a decision from Kansas which included this
passage:
[i]n the absence of a contrary expression of
intent, it is logical that
engagement rings should be considered, by their
very nature,
conditional gifts given in contemplation of marriage. Once it
is
established the ring is an engagement ring, it is a conditional gift.
And in 1997, an Indiana court said:
In our society, an engagement ring � i.e., a
gift incidental to an
engagement � is the symbol and token of a couple�s
agreement to
marry. As such, marriage is an implied condition of the
transfer of
title to the ring and, thus, the gift does not become absolute
until the
marriage occurs. Put another way, marriage is a condition
precedent
before ownership of an engagement ring vests in the done.
And in 2005, a Wisconsin court ruled:
We find the conditional gift theory particularly
appropriate when the
contested property is an engagement ring. The inherent
symbolism of
this gift forecloses the need to establish an express condition
that
marriage will ensue.

Ok... So I am a big Tennessee fan that is pretty much a given.
But Saturday night Mitchell was laid out on the field and Cal fans were cheering play football.
The kid didn't move for at least 10 minutes and we finally saw movement from him as he was being carted off the field. Too me that is poor sportsmanship.
If there is a player down on the field you don't yell keep playing football.. you wait and see what is wrong with him.
Of course there were people protesting in trees at the game.
It was a great game until then. Ya, Tennessee had no defense but hopefully they will get it between now and Florida.

It has been quite a few years since Marshall was the dominate team in the NCAA division 1 team but they made the move to the MAC and have since fallen off the map. They aren't a bad team but they aren't dominate like they were when they were division 1.
I guess we will see what happens to App State in the next few years... They have clinched the National Championship for their division for the last two years.
By the way if you missed the Michigan vs. App State game on Saturday you have to watch the highlights!! IT was a great game!!

Most of us have our favorite NFL team.
We live for the Sundays where we can sit around with our closest friends and watch games all day long. When I lived in Tennessee my friends has a very interesting display so we wouldn't miss a moment of any game.
They would gather all the TV's in the house and set them up so everyone could watch their team. We would still miss a game or two but it was amusing when people would start yelling at one tv and others were screaming at another tv.
I am looking forward to my falls filled with football!! Saturdays are reserved for watching The University of Tennessee do a little damage in the SEC and Sunday's are for the Bengals and hoping they are better than they were last year.
Who is your favorite team and why??

While most people aren't excited about the triple digits, I can honestly say I love them!
I can't wait for the weekend because it gives me the perfect chance to head up to the mountains and cool off and not freeze.
I hope that everyone enjoys their week and hits the mountains to enjoy the great outdoors.

As we all know Paris Hilton was released from Jail after just three days. The jail cited health issues and now she is being confined to her home for the next 40 days. A Hilton mansion, that doesn't sound rough!! And I am not sure that she won't learn her lesson about driving drunk. Should we start guessing when she will get behind the wheel and start driving again.
They are holding her to a completely different standard then the rest of us. Have you all ever noticed that they all seem to get off easy. If anyone of us were caught regularly breaking the
law a Judge wouldn't hesitate to throw us behind bars.

Why does it feel like every time mother nature throws something at us people forget how to drive?
It doesn't matter what state you are in whenever the roads are wet it seems that people just want to crawl!
Just go the speed limit and try to keep it moving. If you want to crawl down the interstate get in the right hand land and stay out of the left one!
That is my rant! I am sure that my commute home will be just as bad.
